Defendant-appellant John Fox (Fox) appeals his conviction of conspiracy to possess with intent to distribute and to distribute cocaine, in violation of 21 U.S.C. § 846 (Count I), and of interstate travel for the purpose of promoting unlawful activity, in violation of the Travel Act, 18 U.S.C. § 1952 (Count VI). On appeal, Fox asserts that: (1) the district court erred by denying his motion to suppress evidence seized at his arrest; (2) the evidence is insufficient to support his conspiracy conviction; (3) the district court erred in refusing to give Foxs tendered jury instruction concerning the difference between a conspiracy and a buyer-seller relationship; and, (4) the government failed to prove a "business enterprise" within the meaning of the Travel Act.
